had just returned from war. bob redell joins us live in san jose with more. good morning, bob. >> reporter: good morning to you, laura. we have spoken with the father of allan devillena from here in san jose and he tells us and he thinks that his 22-year-old son would not have started a confrontation with police. he says he knew better. the family has already left their home here in san jose for palm springs where their son was shot and killed by police early saturday morning. it was two bicycle cops responding to loud voices in a parking garage in downtown. they recognized devillena from an earlier drunken public incident. when they ordered him and his passenger out of the car, the marine drove off. police fired their weapons, hitting and killing devillena. >> after we collect the witness statements, the statements from the officers involved and the evidence at the scene, we'll have a better determination of what actually occurred, what was occurring in the minds of the officers and what led them to use their weapons in this incident. >> reporter: devillena's friend was not h

favro is live in san jose. it's not sitting well with parents. >> reporter: no it really is not, jessica. the registered sex offender was volunteering here at this parish last month during a church festival. parents tell me there were hundreds of kids at that festival. when deputies questioned him, he produced a letter from the church that gave him authorization to be here at the school. tonight, both sheriff's deputies and the diocese are investigating that letter. >> the controversy centers over whether this man is a registered sex offender convicted of child molestation should have been volunteering in san jose at a pair irn. a parent alerted a sheriff's deputy working security that he was a sex offender. >> our deputy made contact with the man who was cooperative throughout the incident. made contact with mr. gear i. he did acknowledge that he was a sex registrant. our deputy confirmed it through dispatch. however, mr. gear i provided information that he had permission to be on school grounds by way of a letter from church officials that gave him permission to be there. >> surprising

on the in the search for a killer in the south bay. police san jose found the body of troy nosenzo this afternoon, the day after police say he killed his wife. officers say they found him in his car parked on the side of the road on highway 129 south of gilroy. they believe he committed suicide by overdosing on sleeping pills. his wife, tra tricia nosenzo was found dead yesterday in the couple's home in san jose. they did say someone called 911 around 5:30 in the morning and then hung up. troy and patricia had been married for 27 years. family members say they had been going through marital problems but nothing they thought would lead to this. >>> the oakland raiders are in baltimore preparing for tomorrow's game against the ravens and they'll play with heavy hearst. a defensive line coach's son died. terrell williams' 4-year-old son tyson suddenly became sick and died last night at oakland children's hospital. the head coach dennis allen released a statement today saying "we're all deeply saddened by the passing of tyson son and our deepest sympathies go out to terrell and his entire family." th
